General Terms and Conditions

The Kunstmuseum Thun and Thun-Panorama (hereinafter referred to as “museum”) delivers any products ordered from the web shop based solely on the following terms and conditions, as applicable at the time of ordering. The museum cannot accept any arrangements that are at variance with these terms and conditions.
2. Conclusion of Contract
A contract is concluded once the museum accepts the customer’s order by means of e-mail confirmation. The broad contents of the order are specified in this confirmation. If the customer, in ordering, has provided the museum with an incorrect e-mail address and the museum’s confirmation e-mail cannot be delivered, the contract will be concluded once the museum sends the customer the confirmation in some other form.
a) All products are shipped through the Swiss Post Office.
b) Products will be shipped to the address provided by the customer.
c) Delivery will take place only upon receipt of the amount due.
d) Generally, shipping within Switzerland takes three days, within Europe seven days, and to other countries fourteen days.
If, at one point, the museum is unable to deliver the products ordered or if there is a delay in shipping, the customer will be notified by e-mail. Should the museum, through no fault of its own, be permanently prevented from delivering the products ordered, it is entitled to withdraw from the contract.
4. Shipping and Handling Charges
With each order, postal charges as well as a packaging fee are incurred. Postal charges are based on the postage rates of the Swiss Post Office. If products are shipped abroad, customs duties may be incurred; the customer bears these fees as well as the aforementioned charges and will be invoiced separately for them.
5. Prices and Terms of Payment
All prices are in Swiss Francs (CHF) and include VAT, as required by law (if applicable). The amount due may be paid per payment against invoice (only within Switzerland) or prepayment.

The customer has the right to return ordered items up to 14 days after their receipt. The right to return merchandise is limited to manufacturing defects and wrong deliveries. The right to return does not apply to products (CDs, DVDs, videos) that have been unsealed by the customer. When returning items, the customer shall specify the reason for their return. The museum shall replace the item(s) expeditiously. Merchandise should be returned to the following address:
When returning items, the customer shall bear the shipping costs. In case it is not possible to replace a product, the amount paid against invoice or by prepayment shall be refunded to the customer.
Claims for damage are excluded, unless the damage is the result of an intentional or grossly negligent act on the part of the museum. The museum is on no account liable for consequential damages and loss of profit. Product liability remains unaffected.
9. Applicable Law and Jurisdiction
The provisions of Swiss law apply. The place of jurisdiction is Thun, Switzerland. Should any provision or provisions that are part of these General Terms and Conditions be found invalid or unenforceable, the validity of the remaining provisions shall remain unaffected by this.
